MoodBridge Terms of Use

The terms that govern access to and use of MoodBridge.

1. Acceptance of These Terms

Welcome to MoodBridge.

These Terms of Use ("Terms") govern your access to and use of the MoodBridge mobile application ("MoodBridge", "the App", "the Service"), developed in France.

By downloading, installing, accessing, or using MoodBridge, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the App.

2. About MoodBridge

MoodBridge is a communication application designed to help users voluntarily share their current emotional state with trusted supporters.

MoodBridge allows a Mood Sharer to:

Share one of several predefined moods.

Send an optional personal message.

Customize mood descriptions.

Connect trusted supporters.

Supporters may receive mood updates and optional messages from users who have chosen to share them.

MoodBridge is intended solely as a communication tool.

3. Eligibility

You must comply with the laws applicable in your country when using MoodBridge.

If you are under the minimum legal age required in your jurisdiction to accept these Terms independently, you may only use the App with the permission and supervision of a parent or legal guardian.

4. User Responsibilities

You agree to:

Provide accurate information where required.

Use MoodBridge responsibly.

Connect only with people you trust.

Keep your recovery code secure.

Keep your device reasonably protected.

Maintain the confidentiality of your account credentials.

You are responsible for all activity performed through your account.

5. Acceptable Use

You agree not to use MoodBridge to:

Harass or threaten others.

Share unlawful content.

Impersonate another person.

Attempt unauthorized access to other users' information.

Disrupt or interfere with the operation of the Service.

Reverse engineer or misuse the application except where permitted by applicable law.

6. Notifications

MoodBridge may send push notifications to connected supporters.

Notification delivery depends on factors outside the Developer's control, including but not limited to:

Internet connectivity.

Mobile network availability.

Device manufacturer restrictions.

Operating system behavior.

Notification settings.

Third-party service availability, including Firebase Cloud Messaging.

Accordingly, notification delivery, timing, and reliability cannot be guaranteed.

7. Recovery Codes

Recovery codes are provided to assist users in restoring access where applicable.

Users are solely responsible for safeguarding their recovery codes.

The Developer cannot recover, replace, or restore lost recovery codes.

8. Donations

MoodBridge may provide users with the opportunity to make voluntary donations.

Donations are entirely optional and are not required to access or use the core functionality of the App.

Donations do not create any contractual entitlement to additional services, features, or support.

Payments are processed through independent third-party payment providers and are subject to their own terms and privacy policies.

9. Third-Party Services

MoodBridge relies on third-party services, including but not limited to:

Firebase Authentication

Firebase Firestore

Firebase Cloud Messaging

Firebase Crashlytics

Firebase App Check

Google Play Services

PayPal (where applicable)

These services operate independently and are governed by their respective terms and privacy policies.

The Developer is not responsible for the availability, operation, security, or policies of third-party services.

10. Medical Disclaimer

MoodBridge is not a medical device.

MoodBridge does not provide:

medical advice,

psychological advice,

psychiatric advice,

diagnosis,

treatment,

crisis intervention,

professional healthcare services.

Any information exchanged through MoodBridge reflects only the voluntary communication of users.

Users should consult qualified healthcare professionals for medical or psychological concerns.

11. Emergency Disclaimer

MoodBridge is not an emergency communication service.

It must never be relied upon to request or obtain emergency assistance.

If you or another person may be in immediate danger or require urgent medical or emergency assistance, contact your local emergency services immediately.

12. Service Availability

The Service is provided on an "as available" basis.

The Developer does not guarantee uninterrupted availability.

Maintenance, technical issues, third-party service interruptions, internet outages, or other events may affect availability.

13. Disclaimer of Warranties

To the fullest extent permitted by applicable law, MoodBridge is provided "as is" and "as available" without warranties of any kind, whether express or implied.

This includes, without limitation, implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, and non-infringement.

13A. Technical Risks and Device Responsibility

The User acknowledges that the installation and use of MoodBridge are undertaken voluntarily and at the User's own discretion and risk.

To the fullest extent permitted by applicable law, the Developer shall not be responsible or liable for any direct or indirect loss, damage, interruption, or adverse consequences arising from or related to:

Damage to or malfunction of any mobile device, tablet, computer, or other hardware.

Loss, corruption, deletion, or inaccessibility of data, files, contacts, messages, photographs, documents, or other digital content.

Operating system failures, software conflicts, application incompatibilities, firmware issues, or device manufacturer restrictions.

Reduced device performance, increased battery consumption, storage usage, network usage, or internet or mobile carrier charges incurred while using the App.

Failures resulting from device modifications, rooting, jailbreaking, malware, viruses, unauthorized software, or unsupported operating system versions.

Temporary or permanent unavailability of third-party services, including cloud infrastructure, authentication providers, notification services, payment providers, or internet connectivity.

Users are solely responsible for:

Maintaining appropriate backups of their devices and personal data.

Keeping their devices updated with supported operating system versions.

Protecting their accounts, credentials, and recovery codes.

Ensuring that their devices meet the minimum technical requirements for the App.

The Developer does not guarantee that MoodBridge will operate without interruption, error, incompatibility, or unforeseen technical issues on every device or operating system version.

Nothing in this section limits or excludes liability where such limitation or exclusion is prohibited by applicable law.

14. Limitation of Liability

To the fullest extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to the use of MoodBridge.

Without limitation, the Developer shall not be responsible for:

delayed or missed notifications,

communication failures,

internet interruptions,

device failures,

operating system restrictions,

third-party service interruptions,

loss of data,

emotional, financial, or consequential losses arising from the use or inability to use the App.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

15. Intellectual Property

MoodBridge, including its software, design, branding, graphics, logos, text, and other content, is protected by intellectual property laws.

Except as expressly permitted by applicable law, no part of MoodBridge may be copied, reproduced, modified, distributed, or exploited without prior written permission from the Developer.

16. Changes to the Service

The Developer may modify, improve, suspend, or discontinue any part of MoodBridge at any time.

Where required by applicable law, users will be informed of material changes.

17. Changes to These Terms

These Terms may be updated from time to time.

The latest version will be made available within the App and/or through the official MoodBridge website.

Continued use of MoodBridge after updated Terms become effective constitutes acceptance of those changes.

18. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of France, without prejudice to any mandatory consumer protection rights applicable under the laws of the user's country of residence.
